I am having an issue that I am sure just about everyone has had to face in the past. I am a fairly new homeowner, so I am not sure how to handle the situation so any little advice would help and be very much appreciated.........I have two neighbors whose fence is in dire need to be taken down and replaced. Not too long ago I had to replace my fence and the neighbors that shared the fence with us agreed to go in half with us to replace the fence. ( I thought this was the normal way to buy a fence)
The other two neighbors are not taking any initiative to replace their fences . I left a note on one neighbors door and the other suggested that I pay for his fence to be put up. Correct me if i am wrong, but I have called 4 companies who install fences and they told me that generally , if the smooth side of the fence is facing you, it belongs to you. Even so, I am willing to go in half with my neighbors to pay for a replacement, yet it seems as if my neighbors want to take advantage of me and try to force me into paying for all of the cost.
I have tried to call the neighborhood service code enforcement committee to see what can be done about this issue. They told me that if I was to call on these neighobrs that we would both get a citation for the fence.( of couse they gave me a long speech about how sorry they are that I am trying to keep the neighborhood looking nice and will get punished for it) One of the fences has fallen down and I could look right into their yard so I stood the fence up were it is leaning on my tree, the other fence is on its way down, it could fall at any minute.
Are there any suggestions out there? I am thinking about waiting it out and see if they approach me about thier fences or going ahead with the citation which will lead to court and both of us eventually having to pay half of the expences, but at least I would not have to pay all of the expense for someone elses property.
