If you provide me with your e-mail address, I have the CCR's in pdf format. These are originals, as they have never been changed. I will warn you though that the CCR's are out of date and many laws overrule some of our CCR's.

The HOA is not yet considering spending 250k to fix the errosion and drainage issues. The engineer was paid last year to servey our property and give us an opinion on what needed to be fixed and who was responsible for fixing it (the builder or the HOA). He was just supposed to present his opinion at the meeting, he wasnt supposed to spend an hour going through boring photos! The lawyer was there to "observe" his opinion beings they are the ones who will be going after Providence. She was also there to answer any questions regarding this issue and what the process would be to get the ball rolling. So, no, the HOA is not considering spending 250k that we don't have right now, to fix all these issues.
In regards to the CC&R's, Oasis has now posted them on their website. Call Brett and find out how to log onto your personal account. You can check your ballances, look at any violations you have (if any), pay your bill, and read all the CC&R's.
The terms (of all the board members) is up in Nov/Dec of this year. |

As BG said, many of the CC&R's conflict with Arizona Law. When there is a conflict, the law takes presidence. I spoke with our attorneys about this and asked if the management company could just go in and change the illegal regulations and make them legal or just eliminate them....the lawers said no, they could not do it. We need to follow the direction of the CC&R's when it comes to changing them. Basically, we need at least 1/2 (i believe) affirmative vote from community members to change any CC&R. I know, it's stupid. If it's illegal, how can it be a valid regulation? It can't, but we can't change them without a vote. So, bascially, it is EVERYONE'S responsibility, board members and community members, to make sure that illegal regulations are not being enforced. Personally, I read up ALOT on the state laws regarding HOA's, so I do my best to make sure we are not enforcing illegal regulations. |
