The Association as of January 2003 will be assessing nuisance fees for anyone who is in violation of deed restrictions. These deed restrictions were given to each member when you accepted the title to your home.
If you do not have a copy of the deed restrictions, contact your settlement attorney or you may obtain a copy from New Castle County.
It is best to review these deed restrictions as anyone in violation will be assessed a fee for each violation that is encroaching upon the community.
Every homeowner upon acceptance of your deed, whether you were told or not told about the deed restrictions is bound by these.
If you have any problems because a seller did not disclose that this community is a deed restricted community, you may bring litigation upon the seller and possibly the real-estate agent for non-disclosure.
Just about every community established after 1988 is a deed-restricted community.
