As a result of the Planning Commission's decision to reject the application presented to them the developer was advised to get together with the neighbors before resubmitting a new applcation. It was pointed out by the Commission that this did not mean that there would be nothing built on the site. The Developer exercised his right to appeal their decision to the the full City Counciland.At that meeting the Agreement outlined below was presented and was accepted by the City. Accordingly the Agreement will be incorporated into the site plan and it is expected that the work will commence in the near future. Unfortunately this will mean that the pool will be closed until next year. In the mean time the pool at Easter/Gartrell will be used.
Agreement has been reached for the developer to donate land he had previously promised on which the neighbors could build a Club House. A revision to the plans and elevations has been made to make the whole Developement more compatible with the homes in the area. A separate car park has been agreed upon and a number of restrictions on the uses have been agreed. All of the changes were presented to a meeting of the home owners on Thursday 5th Feb 04 and were generally well received.
The club house will be owned by the Saddle Rock Metro District and the Agreemnet contemplates no increase in the due as a result.
The club house will be similar to the HOA club house at Murphy Creek on the inside. While no decision has yet been taken on how the Club House will be used, it is noted that the one at Murphy Creek is generally kept locked and is hired out to home owners there based upon a deposit of $500 to cover damage to the interior while being hired plus a usage fee of $5 per day per head with a minimum of $100. Since the developer there is also Alpert it may be assumed that a similar basis will be used here. There is some feeling fooorom some of the neighbors here that they would like to use the club house while at the pool. A small group of neighbors is investigating how this could be achieved, given the general feeling that the club house must not become a finacial burden on the remainder of the neighbors. Whether a lump sum access fee to cover the cost of cleaning and other operating expenses would work is being looked into.
