Fencing for Backyards and Pools

Sep 27, 2005

The BOD of directors was asked back in May to address the issue of allowing more choices for fencing oustide of the A post and rail that is in the covenants. As all of you know, we put this issue out for a vote in June and then communicated out to the residents the result of the motion. The motion to allow additional choices for fencing failed to pass with the necessary 2/3 majority of votes, and therefore the existing rule of allowing only A post and rail is in effect.

The BOD of directors recognizes that there are 2 situations where residents have constructed decks that are serving the purpose of "fencing" around an inground pool. While there is nothing in the convenants dictating the size and structure of decks, in both of these cases the deck is serving the purpose of a fence and should fall within the covenants regarding fencing. That being said, the BOD has decided that we will grandfather the existing 2 "deck pools" that have been constructed, but that for future fencing around pools insist that residents follow the existing covenants, or put forward a petition to change fencing choices for around pools. Several residents have indicated a desire for wrought iron or other specific choices which were not addressed in the first petition. Our suggestion as the BOD is to use the process to suggest any changes, and that being specific will allow for a clear understanding of what change is being requested.
