The developer is Jim Kimberlin.  I don't have a lot of respect for him either for causing all this mess of a HOA where some are liable and others are not.   I guess if you are in Section C or your name is Gandy or Tong you are enjoying this immensely.   They really pulled a good one and did it in a very dishonest way. 

For the record, at the meeting Mr. Gandy insisted we needed this HOA for insurance protection. Since most all the land we are paying to take care of is behind Section C and they legally cannot pay dues or vote or be on the board then how is this insurance suppose to protect them.  They can be sued individually I presume since if anyone did want to go to the common area behind Section C's home they would have to trespass in the yards of the Section C homeowners. 

Now that I think about it this is comical since on the flip side Section C is not protected by the insurance and one must go through the Section C property to get to the "so called common area"   This is quite amusing.

Okay, the original developer.  That money has not been legitimately shown to be accounted for, records/receipts.  In my opinion, the houses that back up to the thin strips can be cut by the respective homeowner, just push that mower an extra ten feet and save everyone the insurance liability of a homeowners association.

You're not getting it.  Pushing the mower an extra ten feet is not going to get it.  It's more like push the mower around the block to get behind all of the fences.  Keeping it mowed isn't the whole issue either.  Who's responsible for cutting down the dead trees that are causing havoc in our yards.  That's why insurance is needed.  I've already contacted my insurance about who would be responsible for damages caused by these trees.  My homeowners will pay up front to repair damage, but they will go after the repsonsible party to get their money back.  According to the city. the responsible party is the homeowners of the subdivision.  Having insurance will cover everyone from incidences like this.  Having the HOA will cover having hazards like this being removed.

all the money has been accounted for.  the board has the ledgers from before and its all documented.  anytime you want to look at them let me know and i will be more than happy to show them to you.
