well, when it comes to the future events I can say we just got a bit of good news!
The county has accepted the streets and drainage areas in unit 4&5. We are currently waiting on Commisioner's court to finalize the acceptance... hopefully it will be done in the next few weeks BUT I know government can take FOREVVERRRRRRR.
How does this effect the events? if we no longer have to pay to keep the drainage (all along Krie trail and the span of Liberty Green and Vandenburg Way) we will save over $9000 a year! All because the county will maintain and mow it, which is something we have had to do for the last 5 years. We will still however be responsible for Unit 1-3 and the drainage behind Shorebird.... explanation follows.
As for the fence along Kriewald and Roads in Unit 1-3... well that is sticky. See OBRA homes originally built that fence and the roads in Unit 1-3 (Acadian - Sandflat) Well they went bankrupt and bailed out on 7 communities in the area. In comes Sivage homes. They purchased the, then, undeveloped land in the HOA. They did NOT purchase enything else (roads, fences, etc) Legally they have no responsibility to maintain the fenceline along Kriewald for 2 reasons... #1 OBRA built it and #2 all fences within the HOA are legally within the land purchased by the homeowners and therefore, the property owners' responsibility according to CCRs. I will say that Sivage Homes has
been a true asset when it comes to helping us deal with the county to fix OBRA's bail-out.
They DO however have to maintain the fence behind the model and sales office because it is located on land that is owned by Sivage homes. I did notfy them of it personally. The VP of development is going to have it repaired ASAP... usually they are pretty good about getting it done quickly once notified. I am more mystified that the sales office didnt notify Sivage of the needed repairs.
