McIntyre Matters

Hello to all,  Before I get started I want to first say to you that McIntyre has been seriously short changed by the CENTEX Corporation. I know of many Homeowners in our community who are and have been lied to by them. A lot of our dealings with the CENTEX Organization have come up way short of the certainly obvious and expected outcomes. In some circumstances our dealings with CENTEX have been very unpleasant. We (the McIntyre HOA) are currently in a fight to take care of what many thought was finished business with CENTEX. Over a year ago CENTEX pulled out of our community seemingly finished with the construction and completion of this project. Before CENTEX can leave a community they are suppose to conduct a final walk through/ inspection with the community's HOA to make sure that all has been completed and any concerns of the community are addressed. At the time of this inspection McIntyre's HOA  presented a detailed list of concerns and incompleted work. What was supposed to have taken a few weeks for them to address turned into a couple of months and that was only after numerous inquiries from your HOA. CENTEX continually delayed answers with various excuses. I want to make available to anyone who is interested the "list of concerns" along with CENTEX's response. The HOA had been informed by CENTEX representatives that upon an inspection by the city all of the streets would be turned over to the City of Charlotte for maintenance and care. Also that all adjacent common areas would be turned over to McIntyre as well. Recently we had a hole that needed to be fixed on one of the streets in our community. It was reported to the city for repair. We (the Board) were informed by the city that this particular street was a private street. (A private street is one that is the community's responsibility for maintenance.) CENTEX was contacted and they said that their records showed that the street had been turned over to the city. Upon further investigation we found that several streets in McIntyre are showing private. The city also informed us that the streets were never inspected for turnover to them. The city does an inspection to make sure that the streets are "up to their standards" before they accept responsibility for them. Since then the city has come out and done an inspection on our private streets and they have failed. What this means is that the builder(CENTEX) must come back and do the necessary work to bring streets up to code standards. We also had to have the street with the hole repaired so further damage would not occur and no one would get hurt. That is a cost McIntyre hopes to be reimbursed for. Next issue is that we (the HOA) have been asking for a survey of the McIntyre subdivision for the last 2 years and have yet to receive it. For whatever reason the survey of this area seems to be privileged information. When the city archives were searched they were'nt able to locate them. I can't begin to tell you how many times I have requested this info from CENTEX. I still don't have them. With the current construction happening in our immediate area it would be nice to know our exact boundaries so we can make sure our lines aren't crossed. We also found that there are a couple of areas of land that should be the property of McIntyre but aren't. The owners of this property are listed as being CENTEX. I had a call from a fellow neighbor that CENTEX was in the community last week looking for homes by their lot numbers. The lot numbers is the system used by the builders to identify homes. CENTEX is trying to get the owners of these lots to sign some type of papers. As of this writing I'm not exactly sure what these documents are but I urge anyone who is or has been contacted by CENTEX not to sign them for it may compromise McIntyre's legal rights to holding them to correct any unfinished business they have yet to do. The list goes on but does anyone else sense the alarming irregularities? The McIntyre HOA is putting their facts together. My calls to CENTEX on last Thursday as to why and what they had representatives in our community for were not returned. When we have the community meeting on July 26 I hope I can have answers to a lot of questions. I/We need your support as well as your voice. Take a moment and contact CENTEX and ask them what is going on in McIntyre? Are you going to take care of our concerns? Our problems here are not of our doing, it is what we were left with. Hi Neighbors,

In light of what's been going on with Centex and our community, I strongly encourage you all to come out and be apart of our next neighborhood meeting.  This will be held  on July 26 @ 4:30 pm @ the pool.  If you're unable to make it send a responsible person on your behave.  You may have questions or want to share your own experiences with Centex with the Board.  This information could be pertinent.  Remember, for your protection, do not sign any documents if approach by Centex.   I hope to see you all on the 26th.
