omg, I'm going to assume you're kidding, right?  Don't give me a heart attack this early in the morning!  lol!

 

Actually, Alicia from Curry tells me that a couple of things need to be in place before the pool opens.  One is that they're working on an access method (lock and entry cards) that will keep trespassers out. (there have already been incidents of fence climbers getting into the new pool).  I don't know what the other things are, only that she said the pool opening has been delayed.  I really don't want to assume anything else, because rumours can get so inflated. 

 

Apparently, the Board of Directors has voted to collect back HOA dues instead of start fresh as of July 1, 2010.  We all know that there were months, even a couple of years, when we were not getting the services HOA dues were supposed to cover.  (pool closings, no electricity, etc. etc.) so I can only imagine how this little bomb is going to go over. 

 

I guess it's just a wait-and-see situation.  It would sure be nice to be getting what we're expected to pay for, especially with July's sweltering summer heat.

 

And yes...I do want what's best for the neighborhood, but I also want the things I'm paying for with HOA dues.  There's contractural responsibility on both sides of that fence. 

Worried Homeowner, What a breathe of relief to see you start to look at things realistically. There really is nothing we can do about the back dues. Pay them or get a lien on your house. You have no say in matters any more. None of us do.

 

Curry management/Union Bank are not about the homeowners, rather about making as much $$$$ as possible, as evidenced by their push to collect back dues. They will also be raising dues for next year. This is a fact. They will bleed this neighborhood dry very quickly.

 

Houses will be on the market very quickly once this happens. Which will drive down property value.

I would like to know why the Board voted to push for back dues. 

 

It was my understanding that the bank agreed to pay for repairs to get everything up and running so they could unload properties and recover their loss.  (kinda like buying a fixer-upper and spending the money to fix it up for resale) The bank introduced Curry as a competent property management company and residents voted to use their services.  Curry works for NCV, right?  Not the bank.  Which gets back to why on earth WE (the board) voted to have Curry push for back dues.  Who initiated this, anyway?  Some back dues are uncollectible because those people have gone.  Lost their jobs, lost their houses, moved.  I doubt if most people have several thousand dollars lying around to catch up back dues.  As I am sure you are aware, a lot of people some time ago, stopped paying dues because we weren't getting contractual services promised.  The cash-strapped developer, now bankrupt,  apparently was using HOA dues for something other than NCV services.  We were paying dues and left with a scummy, mosquito-infested pool closed by the health department, no lights or heat in the clubhouse most of the time, a huge unpaid water bill and a community building vandalized by Ferrelview trespassers with broken games, holes punched in the walls, furniture burned with cigarette butts and a mold-covered refrigerator. The 'lawn maintenance' was a joke, with ripped siding, plants mowed down and grass left so tall the only way you could tell it was mowed was from the ruts left in the yard by mower tires.  The 'park' has never been anything but an overgrown weed field with dead and dying trees.   This is what we got for our HOA dues.  I don't blame people for not paying them.

 

Now, somebody wants to be the "new sheriff in town" and go on a rampage to collect back dues.  Well, guess what?  Residents have a say in this, too, and there's such a thing as both parties of a contract holding up their end of the bargain.  I believe it's called 'specific performance' and we should seek legal recourse instead of rolling over and paying for months of non-service.

 

What do you think?  Is anyone out there willing to pitch in for legal assistance in fighting this 'back dues' bullying?  Has anyone talked to whoever the president of the Board is about the ridiculousness of this??

 

 

 

 

I'm still waiting for contact info for the new Pres.  Will fill you in when I have it.  I'm not going to lose sleep over this until I get something in the mail trying to bill me for past due dues.  Then I will do what I have to.  That said, I am (fortunately and unfortunately) going to be putting my house on the market in a few months because I inherited a house recently and am moving.  I'm not looking forward to selling in the middle of all this.  I am not upside down on my house, though, so it should turn out okay.  

 

I'm probably the neighbor that everyone complains about, anyway, with the toys and the gardens.  I'll be out of your sight soon enough!
