PPCA Architectural & Covenant Review Updates - June 2006

Dear Neighbors: A note to bring the Community up to date on various building plans submitted to the Board over the past two years. Please pass this along to other neighbors, as we are continuing to solicit 100% participation with email addresses from all community members for electronic email broadcast of community related news.

Four sets of plans from homeowners have been submitted to the Board of Directors for PPCA Board building approvals on additions and new construction. Two projects were presented to the sitting Board in the year 2005, and two proposed construction projects have been submitted to the 2006 Board. The status of the submissions are presented below, along with comments on a proposal to study and examine our Covenants with regard to regulating building size within the Community.

> Urbach Garage:
> Plan: A plan to erect a Garage on the Urbach property was approved in
> 2005.
> Status: The garage was built in 2005 and is in use.
>
> Brill Addition:
> Plan: To build a den in the second floor addition. Plan submitted and
> approved 2005.
> Status: No plan to build as yet.
>
> Polk Addition:
> Plan: To build an addition over the garage creating a second floor for
> storage. Plan
> submitted and approved in 2006.
> Status: No building yet started.
>
> Cate New House 2006:
> Plan: To build an 8,000 square foot house with two 1,000 square foot garages for 6 cars on the lot at 2111 Harbor Drive.
> Status: The Cates have building approval from the County under R2 zoning grading and building permits.
The Cates submitted a building and site plan to the Board which was not approved.
The house was moved closer to the road and toward the right bringing it 14 feet from their neighbor's (Mr. Kohler) property line. This plan was rejected by the Board since it violated the side setbacks in our Community Covenants. The Cates have submitted a dated plan June 7th, 2006 showing the house 15 feet from the nearest neighbor which is now in compliance with our side setbacks.
> Comments:
> The Cate house has brought up the question of house size, height and scale for Podickory Point. Our Covenants address only a minimum house
size. Our reliance is on County building codes within R2 Zoning regulations regarding maximum size of single family dwellings. The question is
very complex, regulating a home owner's right to build what he pleases on his property, versus maintaining our Community aesthetic standards and scale of home size, garage spaces and the possible line of view and sunlight obstruction issues to nearby or adjacent homes.

Your thoughts are welcome as to the existing Covenants being adequate, or conversely the need for Covenant changes. Covenant enforcement can possibly require process within the legal system and therefore, require legal services to be funded by the Community Association. Covenant enforcement could very well initiate additional assessments.

Please note that community members are required to submit proposed lot improvement plans to the Board, prior to beginning the improvements. In addition, if an engineer or architect is to be hired by you to submit such plans to the County for permits, it is incumbent upon you that those professionals be provided a copy of our local Covenants to ensure compliance. Your Covenants and Bylaws are located on the Community web site www.neighborhoodlink.com/aacounty/ppca/

All PPCA members may attend and observe any or all Community Association Board meetings as prescribed by Maryland Law - Open Board Meeting statutes. But, please provide advance notification to any Board Member of any issue you might request to be discussed on the Board Meeting Agenda prior to the meeting, and, of course, to allow for the proper accommodations to be made for all who desire to attend. More information will be provided in the near future on the structure of the Community Members' opportunity to observe or attend Open Board Meetings.
