Dog Barking Nuisance

I am having a problem with my neighbor's dog barking and keeping me awake. It barks late and night and early in the morning. I've resorted to taking sleep medicine and putting cotton balls in my ears. But I don't believe I should have to do this. I can't study. I can't read. I can't sleep. I can't concentrate. It's just not fair that I can't do what I want in my house because of the barking. The dog is very loud. We've tried asking him to move it to the other side of his yard where his house will block the noise. He said he would but didn't. Today we tried to contact him again. No one was home so we left a note with a phone number. He called and screamed and cussed at me on the phone. I remained calm and polite thru it all. He said he was not going to quiet it or move it. I said, "Why?" He said, "Why should I? Why should I move the dog just to make you happy? He's going to bark and I'm not going to make him be quiet!" After screaming at me, he hung up. So we called the police. They said make a paper trail - call every time the dog barks and make a complaint and that they would also involve animal control.

 

So after doing this I can sue him in small claims court. During the mean time, I have to do all the work of keeping notes on days and times of the barking, take videos, and gather any evidence that the dog is a nuisance. I don't understand why he can't just do the right thing. We asked very politely......even while being cussed at.

 

My question is: Has anyone ever had to sue someone for something like this? If so, how did it work out?
