Exterior Maintenance Policy

WPHOA will provide exterior maintenance in accordance with the Declaration of Covenants, Restrictions, Conditions and Easements for Whispering Pines. This shall include painting, repair, replacement and maintenance of roofs, gutters, downspouts, exterior building surfaces, as well as, general grounds maintenance, on an as required and funds permitting basis.

Individual owners will be responsible for repairs/maintenance to other exterior parts of their property and in the case of negligence, accidental damage, damage caused by installation/removal of attachments to the structure, etc., through homeowners insurance, collections from damaging party, and /or other means.

Upon failure of any individual owner to implement required repairs after notification by WPHOA, the Association has the right to make such repairs and levy a special assessment, which will constitute a lien on the property, for the cost of such repairs.

Normally, WPHOA will maintain the following items except when deemed the responsibility of the owner:

1. Roofs … (Repairs required because of attachment , removal, damage from antennae, discs, etc and/or their supporting equipment, brackets, etc are the owners responsibilities)

2. Skylights…(Only if installed by original building contractor.)

3. Chimneys for fireplaces installed at time of building construction.

4. Siding

5. Gutters/downspouts

6. Garage door surfaces (not including tracks, motors or operating mechanisms or devices.)

7. Builder installed iron security gates.

WPHOA WILL NOT be responsible for the following items the Board of Directors deems to be the responsibilities of the individual unit owners:

1. Any damage caused by any individual or which would normally be covered by homeowners insurance to include storm, fire, acts of nature or other such casualty.

2. Any damage caused by neglect, abuse or misuse.

3. Damage caused by the installation/removal of any attachment to the unit or lot.

4. After construction changes to the unit i.e. skylights, screen patios, etc.

5. Exterior hose bibs, electrical receptacles, light fixtures/bulbs, doorbells, etc.

6. Window fixtures, glass surfaces, or window, door, and patio screens.

7. Add-on enclosed or screened patios that are not part of the original roof structure.

8. Owner installed fences, posts and gates.

RULES & REGULATIONS (9/99)

1. Additions or changes (privacy fences, screen enclosures etc.) to the exterior of living units or lots are NOT permitted without prior written approval of the Architectural Control Committee.

2. Units are for single family residence use only. No business may be operated out of any unit. The land around each unit is private and should be respected as such.

3. Fishing, swimming, or wading is NOT allowed in the retention ponds.

4. Overnight parking of private passenger or unit occupant’s company vehicles ONLY is allowed. Wreckers and commercial vehicles more than 2.5 tons are prohibited by City Ordinance # 656.411. All vehicles must be in working order with current tags. Only minor vehicle repair work (less than two hours) is allowed outside. PARKING ON GRASSY AREAS IS NOT PERMITTED. Parking of recreational vehicles (boat, trailer, camper, etc.) is NOT allowed.

5. Individual mail or newspaper boxes are NOT allowed.

6. Only standard house pets are allowed. Pets (including cats) must be leashed at all times when not inside a fence. Pet owners must pick up any mess left by their pet.

7. Antennas, satellite dishes or similar equipment may NOT be attached or installed on any unit or lot without prior Architectural Control Committee approval. The homeowner is responsible for any damage that may result from such equipment and for removing and replacing any such equipment when necessary for repairs, re-roofing or any other purposes.

8. Clotheslines must be out of view.

9. Reflective foil or other stick-on material may NOT be placed on windows.

10. Garbage, trash must be in a sealed plastic bag and a closed sanitary container. Containers must be kept out of view except for pick-up days. Containers may not be put out earlier than 6:00 p.m. the day prior to pick-up and must be put away no later than 8:00 a.m. the day following pick-up.

11. Only "For Rent", "For Sale", home security system, and temporary “Garage Sale” signs are allowed. Signs are to be kept in a window, against the house, or in a flower bed. Garage Sale signs are allowed on the day of the sale and must be promptly removed after the sale.

12. Occupants are responsible for watering grass on their lot. Owners will be charged for grass replacement if the grass dies due to lack of water.



VIOLATORS ARE SUBJECT TO A FINE OF $25.00 PER DAY FOR EACH VIOLATION.

About our community

Whispering Pines is a deed restricted community of 546 homes. The buildings consist of single family homes, duplexes and multi-unit townhome buildings.

This great community is conviently located on Collins Road between Blanding Boulevard and Roosevelt Boulevard, approximately 2 miles from I-295.

Board Meetings

The Board of Directors meet the fourth Monday of everyone month (except for February, July and December). After the general meeting of Board of Directors there is an open forum giving homeowners an opportunity to address their Board of Directors.
